Terms of sale (United States)

1. Orders and prices

• Prices are displayed and charged in US dollars (USD). They do not include VAT: sales shipped to the United States are exports from France exempt from French VAT (art. 262 I of the French Tax Code).
• CHUTEX does not collect US sales or use tax. Depending on your state, use tax may be due by you.
• The order is accepted when payment is confirmed by our payment provider (Mollie): card, Apple Pay or PayPal. You receive an order confirmation and a PDF invoice by email.
• Elio Health, Vita and Dorsi subscription plans are not offered on the United States storefront; only one-time device purchases are available online. Chutex Care is available internationally on request (contact us); physician teleconsultation is currently available in France only.

2. Shipping, customs and delivery

• Shipping to the United States is free. Parcels ship from France with a tracked express carrier, usually within 2 business days, and are typically delivered 3 to 7 business days after dispatch.
• Shipments are sent DAP (Delivered At Place): import duties, tariffs, customs fees and any state tax assessed on import, if any, are payable by you to the carrier or US Customs before or at delivery. CHUTEX declares the real value of the goods on the customs paperwork.
• If you refuse to pay import charges and the parcel is returned to us, the product price is refunded less the carrier's return and customs costs actually incurred.

3. Returns, refunds and warranty

• You may return an unused product in its original packaging within 14 days of delivery for a refund of the product price to the original payment method within 14 days of receipt of the return. Return shipping and any non-refundable import fees are at your expense. Deployed Elder cartridges are consumables and cannot be returned once used.
• All devices carry a 2-year commercial warranty against manufacturing defects from the delivery date, in addition to any implied warranty that cannot be excluded under your state law. Contact contact@chutex-innovation.com with your order number; repair, replacement or refund is at CHUTEX's choice, return shipping for a proven defect is paid by CHUTEX.
• Elder cushions a detected fall; it does not prevent falls, does not detect every fall and does not guarantee the absence of injury. It is not a medical alert service: in an emergency, call 911.

4. Product claims and use

• Chutex products are not medical devices and make no FDA-approved, FDA-cleared, FCC-certified or CPSC-certified claim. Elio and Vita provide wellness estimates and are not diagnostic devices. Dorsi supports posture; Model I is a fitness device, not a physiotherapy device.
• Always follow the user manual. Ask a healthcare professional before use if you have a medical condition.

5. Law and disputes

These terms are governed by French law. This does not deprive you of the protection of mandatory consumer provisions of the state where you reside. Any dispute is first handled amicably at contact@chutex-innovation.com; either party may then bring the matter before the competent courts.
